Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. OPEN ONLY TO LEGAL U.S. RESIDENTS (EXCLUDING PUERTO RICO AND THE US VIRGIN ISLANDS).  VOID WHERE PROHIBITED. 

1. Sponsor.

The Safecount Sweepstakes ("Sweepstakes") is sponsored by Safecount, 11 Madison Avenue, New York, NY 10010 ("Safecount" or "Sponsor").

2. Sweepstakes Period.

Sweepstakes begins at 12:00:01 a.m. E.T. on Thursday, January 1^st, 2010 and ends at 11:59:59 p.m. E.T. on Thursday, December 31,  2010. The Sweepstakes is divided into twelve (12) separate Entry Periods as set out below. Entrants may enter Sweepstakes once each Entry Period, but no entrant may win more than once in the Sweepstakes. There will be only one winner per Entry Period.  To be eligible to win the Sweepstakes in any one Entry Period, entrant must have entered in the same Entry Period. Non-winning entries will not be transferred to subsequent Entry Periods.

3. To Enter. There are two ways to enter: 1) Fully complete the online survey and submit with your required personal information and you will be automatically entered into the Sweepstakes; 2) If you wish to enter the Sweepstakes without completing the survey, all you do is mail in your name, address, year of birth, the end date of the Sweepstakes Period, and the Sweepstakes prize, so that Sponsor can notify you if you are a winner and verify your eligibility.  If you are below 18 (between 13 and 17 years old), please provide parental contact information.  Mail-in entries should be addressed to: Safecount, Contests, 11 Madison Avenue, New York, NY 10010.

YOU DO NOT NEED TO COMPLETE THE SWEEPSTAKES SURVEY TO ENTER THE SWEEPSTAKES.  COMPLETION OF THE SWEEPSTAKES SURVEY WILL NOT INCREASE YOUR CHANCES OF WINNING. YOUR CHANCES OF WINNING WITHOUT COMPLETING THE SWEEPSTAKES SURVEY (INCLUDING ENTRY BY MAIL-IN) ARE THE SAME AS THE CHANCES OF SOMEONE WHO COMPLETES THE SWEEPSTAKES SURVEY.  Your mail-in entry must be post-marked on or prior to the last day of the Sweepstakes Period for the identified Sweepstakes and received by Safecount not later than within 10 days after such date.  Mail-in Entries have the same chance of winning as Internet Entries.  Automated or computer generated entries or mechanical reproductions are prohibited, and any use of automated devices or mechanical reproductions will cause disqualification. The end date of the Sweepstakes Period and the Sweepstakes prize are listed on the first page of the Sweepstakes Survey.  LIMIT: ONE ENTRY (PER SWEEPSTAKES) PER PERSON, HOUSEHOLD, FAMILY AND/OR E-MAIL ADDRESS.  Sponsor and its advertising and promotions agencies are not responsible for lost, late, incomplete, illegible, mutilated, inaccurate, misdirected, stolen or postage due entries or mail, or for any problems of any kind whether mechanical, human or electronic, including, but not limited to, computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, or service provider/Internet/web site/use net accessibility or availability, traffic congestion, or unauthorized human intervention. Sponsor reserves the right to suspend or terminate any sweepstakes in the event of any such problem. Sweepstakes entries are the property of Sponsor.  E-MAIL CHANGE OF ADDRESS POLICY: It is your sole responsibility to notify Sponsor in writing if you change your e-mail address. (To do so: write to: info@safecount.net).

4. Prizes.

One (1) winner per Entry Period will receive a check in the amount of $1,000. Arv. of all prizes for Sweepstakes is $12,000. If the prize is not claimed within 30 days after notification is sent, the prize will be forfeited and  may not be awarded in the sole discretion of Safecount.  Federal, state and local taxes are the responsibility of the winner.  If by reason of any error (relating to electronic transmission, technical or human errors or otherwise), more prizes are claimed than the number set forth in the applicable Sweepstakes Survey, all persons making purportedly valid claims will be included in a random drawing for the number of prizes as stated.

5. Drawing; Odds of Winning:

Prize winners will be selected in a random drawing from all entries received by the applicable deadlines.  Drawings will be held no later than 3 days after the Entry Period end date.  Odds of winning depend on the number of eligible entries received in that Entry Period.  

6. Awarding of Prizes.

Each winner will be notified by e-mail (the "Notification") within 15 days of the drawing.  Winners without an email address will be notified via postal mail at the address provided in their entries.  Winners will be required to complete a registration form, which will include an online Affidavit of Eligibility and, where lawful, a Liability/Publicity Release (Tennessee residents need not complete and return publicity release).  Sponsor may require each winner to provide proof that he or she is the authorized account holder of the e-mail address used to enter the Sweepstakes.  In the event of a dispute regarding an online submission, the entry will be deemed submitted by the authorized account holder.  "Authorized account holder" means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or organization (e.g., business, educational, institutional) that is responsible for assigning e-mail addresses for the domain associated with such e-mail address. By completing the affidavit and release, the winners (except Tennessee residents) grant permission to the use of their names and addresses for advertising and promotional purposes for this and similar promotions without additional compensation unless required by law.  Prizes will be awarded within 30 days after receipt of all online registration forms. Prizes are not transferable. Non-compliance with these Official Rules or Terms of Service or undeliverable notification may result in disqualification and selection of an alternate winner.

7. Eligibility.

OPEN ONLY TO U.S. RESIDENTS (EXCLUDING PUERTO RICO AND THE US VIRGIN ISLANDS). VOID WHERE PROHIBITED. To enter, you must be at least 13 years old; persons between 13 and 17 years of age may also enter the Safecount Sweepstakes with verified parental consent.  Employees of Safecount, its affiliates, subsidiaries, advertising and promotion agencies, manufacturers or distributors of sweepstakes materials, and their respective officers, directors, shareholders, agents, representatives and members of their immediate family are not eligible. All applicable federal, state and local laws and regulations apply.  NO PURCHASE OR COMPLETION OF THE SWEEPSTAKES SURVEY NECESSARY TO ENTER OR WIN.

8. Conditions.

A. All Safecount Sweepstakes are governed by these Official Rules. By participating, entrants agree to these Official Rules and understand that all decisions regarding the Sweepstakes including, but not limited to, winner selection, will be made by Sponsor, whose decisions shall be final and binding in all respects. Sponsor is not responsible for (i) lost, late, delayed, misdirected, unintelligible, incomplete or postage due mail or electronic mail; (ii) telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of the Sponsor which may cause the Sweepstakes to be disrupted or misused; or (v) any inaccurate information caused by any reason, including, without limitation, the Safecount website, users, equipment, or human or technical errors relating to the submission of entries. B. By participating in the Sweepstakes, you agree to release and hold harmless Sponsor, its clients, and promotional and advertising agencies, the entities whose names or brands appear in any Sweepstakes Survey, and all of their respective officers, directors, shareholders, employees, affiliates, representatives and agents from any and all losses, damages, rights, claims, actions and proceedings of any kind arising out of or relating to the Sweepstakes or resulting from acceptance, possession, use, or misuse of any prize, including, without limitation, personal injuries, death, and property damage, and any claims based on publicity rights, defamation, or invasion of privacy.  IN NO EVENT WILL SPONSOR, ITS CLIENTS, PROMOTIONAL AND ADVERTISING AGENCIES, THE ENTITIES WHOSE NAMES OR BRANDS APPEAR IN ANY SWEEPSTAKES SURVEY, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, REPRESENTATIVES AND AGENTS BE RESPONSIBLE FOR DAMAGES OR LOSSES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SAFECOUNT WEB SITE OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE SAFECOUNT WEB SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS OFFERED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.  SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. C. Any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes, including, without limitation, relating to any prizes awarded or not awarded, shall be resolved individually, without resort to any form of class action, and exclusively by binding arbitration in New York, New York by a single arbitrator in accordance with the Commercial Arbitration Rules of the American Arbitration Association ("AAA"). Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees. D. The Sweepstakes may be modified, canceled, terminated or suspended in whole or in part without prior notice for any reason, including, without limitation, computer virus, bugs, non-authorized human intervention, mechanical or electronic problems or other causes beyond the control of Sponsor which corrupt or impair the administration, security, fairness or proper play of the Sweepstakes.  In the event of early termination of the Sweepstakes, all prizes will be awarded in a random drawing from among all eligible entries received through the date on which the Sweepstakes is terminated to the extent practicable, as determined by Sponsor in its sole discretion. E. Offer void where prohibited and subject to all applicable federal, state and local laws.

9. Name, address and email.

Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy.  Please review the Sponsor’s privacy policy at www.safecount.net/privacy_detailed.htm.  By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy. 

We use your email address for a few purposes. The first is to inform you if you have been chosen as a sweepstakes winner, if applicable.  The second is to contact you if you have opted in to take future surveys.  We ask for your name and mailing address so that we can send you a check or a prize if applicable.

Age, gender and other demographic information is used to determine a user's eligibility to qualify for a survey.

You will be notified by email if there is ever a change in the way Safecount uses your personal information.

Lastly, we may contact you if we have any questions or concerns about the accuracy of your information. We periodically conduct internal corroboration amongst all our data tables and also validate data fields to reveal any possible inconsistencies in the database. The outcome of this exercise may prompt us to contact you.

And keep in mind - if you ever want to be removed from our database after having opted-in to provide us your information, just contact us via email at info@safecount.net, and we will accommodate your request.

10. Winners List.

To receive a list of winners of a Sweepstakes, send an e-mail request to [winners-lists@safecount.net] and specify 'Winners List', end date of Sweepstakes Period and the Sweepstakes prize (both of which are listed on the first page of the Sweepstakes Survey).  Or send a self-addressed stamped envelope to Safecount, 11 Madison Avenue, New York, NY 10010, Attention: Winners List .
